Child Custody and Visitation

San Jose Child Custody Agreement Lawyer - John S. Yohanan

The most important and most difficult issue to be resolved in any divorce case (as well as paternity case) concerns each parent's right to continue a fully engaged relationship with his or her children.

Most child custody arrangements provide for joint legal custody, which means that both parents participate in the decision making regarding the important issues affecting their child's development and welfare. Both parents have full access to school records and medical records, and decision-making responsibilities concerning the child are shared by both parents.

While both parents share legal custody of their children, usually one parent is agreed to be the primary custodial parent, and will normally receive child support payments from the other parent. The amount of these payments will be reduced by the percentage of time the child spends with the non-custodial parent.

Less common are shared parenting arrangements agreed between the parents. Under a shared parenting agreement, parents share joint physical custody as well as legal custody, and children spend roughly equal time at the residence of each parent.
